Tenant Information

If you are currently renting through O'Brien Bartlett First National Real Estate, your rental agreement folder contains important information for managing your residential tenancy lease. If not, the Property Management department is here to assist you during your tenancy. The following information is designed to assist you in case you need more information.

Rental Payments

Unless other arrangements are made, rent under your Residential Tenancy Agreement will be payable in advance according to your lease schedule. Please note rental payments can only be accepted by:

·                     Periodical Direct Payment

·                     Bank Cheque

·                     Money Order

 

If at any time you are unable to make a rental payment on or before the due date please make immediate contact with our Property Management Department.

 

 
 
 

Rental Bond

Your rental bond will be lodged with the NSW Department of Fair Trading. The bond is held as security against any damage or undue wear and tear. The bond will be refunded promptly after you vacate, provided the property is left in as close as possible to the same condition as when the Residential Tenancy Agreement commenced (allowing for fair wear and tear) and there are no other monies owing.

 

 
 
 

Periodic Inspections

During the course of your tenancy, the premises will be inspected periodically by O’Brien Bartlett First National after 7 days notice has been given to you. These inspections are to check on how the property is being maintained and to see what routine maintenance may be required.

 

 
 
 

Keys

We strongly advise, that you make private arrangements regarding the location of a spare key, should you inadvertently lock yourself out.

 

Locks may only be changed, after first obtaining permission from O’Brien Bartlett First National or the Landlord, and then on the strict understanding that you supply us with a spare set of keys. Remember, it is in your best interests to ensure that we have access to your property.

 

 
 
 

Insurance

We strongly urge you to insure your personal possessions against any loss, damage or theft. The landlord has no obligation to insure your personal belongings.

 

 
 
 

Electricity, Gas & Telephone

It is each tenants' responsibility to have the appropriate account placed in their name(s) and then to arrange to have a meter reading prior to moving in or vacating the premises.

 

 
 
 

Repairs & Maintenance

Repairs may be requested by:

All repairs are attended to as promptly as possible, however, it is often necessary to obtain the Landlord's approval and/or quotes before any work can commence, so unfortunately a delay is sometimes unavoidable.

 

If firm arrangements regarding access for any tradespeople are not kept by you, the service charge for calling the tradesperson will be automatically passed on to you for payment.

 

Where you rent a house, terrace or a semi-detached cottage, the upkeep of the gardens and grounds are your responsibility, unless otherwise formally advised. Please do not store unnecessary paper, rubbish, bottles, cans, etc. on or around the premises.

Termination Of The Tenancy Agreement

Your Residential Tenancy Agreement is a legal and binding contract, providing protection for both you and the Landlord.

The Residential Tenancy Agreement can be terminated by you in the following ways:

·                     If you intend to vacate at the end of your Residential Tenancy Agreement you are required to give fourteen (14) days written notice prior to the expiry of the fixed term of your Agreement.

·                     Once the fixed term has expired, you are at liberty to continue living at the property or to vacate. If you intend to vacate, written notice to that effect must be received by our office at least twenty-one (21) days prior to the vacating date.

 

If however, unforeseen circumstances arise and you have to vacate prior to the expiration of your Residential Tenancy Agreement, please contact our office immediately, in writing, and we will endeavor to find another suitable tenant.  However, you will still be responsible for the rent until another suitable tenant is found, as well as the payment of a letting fee, an Agreement preparation fee and all advertising costs.

 

Please ensure that any other occupants of the property also read this information.

 

 
 
 

Responsibilities of Tenants Over The Premises

Under the law the tenant must keep the premises in a reasonable state of cleanliness, having regard to the condition of the premises at the start of the tenancy.  If the premises include a yard, lawns and gardens, they must also be kept neat and tidy by the tenant.

 

Tenants must notify the landlord or agent of any damage to the premises as soon as practicable, regardless of who or what caused the damage.  It is recommended that this notice be put in writing.

 

The tenant must not intentionally or negligently cause or permit damage to the premises.  Negligence means forgetting to do something which a reasonable person would usually do in the circumstances, or doing something which a reasonable person would not do.  In simple terms, it is lack of care or attention.

 

A tenant is also responsible for damage caused by other occupants or the premises or any person the tenant allows on the premises.

 

A tenant cannot, except with the landlord’s written permission attach any fixture or make any renovation, alteration or addition to the premises.  This ranges from small items such as putting picture hooks into the wall, adding locks or having a telephone installed, to larger matters like painting the whole premises.

 

 
 
 

Removing Fixtures

When removing fixtures the following conditions apply:

 

·          Fixtures added by tenants cannot be removed without the landlord’s permission.

·          If removing a fixture causes damage, the tenant is responsible for repairing the damage or compensating the landlord.

·          If the landlord refuses to allow the fixture to be removed, the landlord must compensate the tenant for the value of the fixture.

 

 
 
 

Water Charges

It is the tenants responsibility to pay for all water usage where the premises are metered separately.

Accounts are sent to O'Brien Bartlett First National & these in turn are sent to tenants for payment.

Accounts are paid to our office NOT the Council.  A late fee of $20.00 has been introduced by the Council for all overdue accounts.

 

 
 
 

The Process

To rent a property through O'Brien Bartlett First National Real Estate you need to:

 

1.        Arrange a time with the Property Management Department to view the property of your choice.

2.        Complete and sign an application (which you can download, or obtain a copy from our office.

3.        Provide our Property Management Department with identification, to obtain 100 points, eg Drivers Licence, Passport, previous rent receipts, rental history, bank statements etc.

4.        Provide references of previous rentals, including previous Agents name, phone number, address and address of the property rented.  YOUR APPLICATION WILL BE DECLINED IF NOT ENOUGH INFORMATION IS PROVIDED.

5.        If and when your application is accepted, you will be requested to pay one weeks rent as a reservation fee which is non-refundable after 7 days.

6.        Arrange a time to sign documentation

7.        At signing you will be required to pay 6 weeks rent being 4 weeks rent as Bond, 2 weeks rent in advance (less any reservation fee already paid) plus a lease preparation fee of $15.00 is to be paid.

8.        Electricity and phone are to be organised by the tenant.
